About EPCs

EPCs are a consequence of the Energy Performance of Buildings Directive (EPBD), which was enacted in the UK as Part 5 of the Housing Act 2004.

An EPC measures the intrinsic energy efficiency of a building and rates it against a pre-determined benchmark on an A to G scale.  EPCs come with a Recommendations Report identifying areas where improvements could be made.  They are valid for 10 years.

EPCs have to be provided in advance of a sale or letting to enable prospective purchasers and tenants to consider energy efficiency as part of their decision-making process.

With a few exceptions (see below), a valid EPC is a legal requirement for a new building or when a building is sold or rented on a new lease to a new tenant.  As soon as you know you are going to be selling or renting a property you should commission an EPC and it should be available for prospective buyers or tenants to view.  As well as getting a fine of up to £5,000, not having an EPC could result in the expensive delay of a sale or rental.

Commercial EPCs can only be produced by an accredited Non-Domestic EPC Assessor. There are three categories of Commercial EPC, each requiring a different level of qualified assessor. The type of Non-Domestic EPC required will depend on the size and complexity of the building and its heating and ventilation systems.

EPC rules for selling and renting

  • An EPC must be commissioned before a commercial or residential building is marketed for sale or rent.
  • Agents involved in marketing commercial buildings are now liable for making sure that the new rules are complied with along with the building owners or landlords.

Exemptions

Only those properties falling within the following categories are exempt from requiring a Non-Domestic EPC:

  • Places of worship
  • Temporary structures with a planned use of less than 2 years
  • Standalone properties with under 50m2 useable floor space
  • Properties due for demolition with a demolition order in place
  • Low Energy Demand properties

The definition of a “Low Energy Demand” building is not necessarily obvious and TGC can advise whether your building falls into this category.

Penalties for Non Compliance

You will be fined between £500 and £5,000, based on the rateable value of the building, if you don’t make an EPC available to any prospective buyer or tenant. Enforcement is by Trading Standards

Minimum Energy Performance Standard

Feed-In Tariffs (FITs) provide a long term payment to individuals and organisations that install a range of small scale renewable technologies. The full FIT payment for Solar PV is only available if an EPC has been obtained and it has a “D” or better rating. There are some exemptions, notably schools and community energy projects.

From 2018 it will be necessary to meet the Minimum Energy Performance Standard which is widely expected to be an EPC “E” rating. It is possible that properties with an “F” or “G” rating will be unable to be sold or rented after April 2018 unless work is undertaken to improve their energy performance. There continues to be some uncertainty regarding implementation of this legislation, but in the meantime many large scale property owners are investing millions of pounds to ensure that their buildings can be sold or let after the deadline date.
